1. Acceptance of Terms
By accessing and using Clear Growth Gardens' services, you accept and agree to be bound by the terms and provision of this agreement.
2. Services Description
Clear Growth Gardens provides professional landscaping, garden design, lawn care, and related outdoor maintenance services. All services are subject to availability and scheduling constraints.
3. Consultation and Estimates
Initial consultations are provided free of charge. Written estimates are valid for 30 days unless otherwise specified. Final pricing may vary based on site conditions and scope changes.
4. Payment Terms
Payment terms vary by project size and duration:
- Small projects (under $1,000): Payment due upon completion
- Medium projects ($1,000-$5,000): 50% deposit required, balance due upon completion
- Large projects (over $5,000): Custom payment schedule provided
- Maintenance services: Monthly billing, payment due within 30 days
5. Cancellation Policy
Services may be cancelled with 48 hours notice. Deposits for cancelled projects are refundable up to 7 days before scheduled start date, minus any costs already incurred.
6. Weather and Delays
Outdoor work is subject to weather conditions. We are not liable for delays caused by weather, permit issues, or circumstances beyond our control.
7. Property Access
Client must provide safe, reasonable access to work areas. Any damage to property due to restricted access is not our responsibility.
8. Warranty and Liability
We warranty our workmanship for one year from completion date. Plant materials are guaranteed for 90 days with proper care. Our liability is limited to the cost of services provided.
9. Insurance
Clear Growth Gardens maintains appropriate general liability and workers' compensation insurance. Proof of insurance available upon request.
10. Permits and Compliance
Client is responsible for obtaining necessary permits unless otherwise agreed in writing. All work will comply with local regulations and codes.
11. Intellectual Property
Design plans and concepts remain the property of Clear Growth Gardens until full payment is received. Unauthorized reproduction of our designs is prohibited.
12. Dispute Resolution
Any disputes will be resolved through mediation or arbitration in accordance with local laws. Legal proceedings, if necessary, will be conducted in the jurisdiction where services were provided.
13. Changes to Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date.
